Placing Your Baby Through an Independent Adoption This type of adoption is usually arranged by a lawyer, depending on the laws in your State. Independent adoption is legal in most but not all States. It is legal here in the State of Ohio. There is generally minimal agency involvement. Your lawyer works with the lawyer for the adoptive parents to arrange the adoption. All States require that the adoptive parents in an independent adoption complete a home study through a licensed adoption agency. In an independent adoption, as with many agency adoptions, you would generally expect to meet the adoptive parents. In most cases, you, as the birth mother, or you and the birth father actually choose the adoptive parents. The information you receive about the adoptive parents will come directly from the family members themselves or their lawyer. You should plan to have your own lawyer represent you and your baby, while the adoptive parents will have a different lawyer represent them. It's important that you have your own lawyer, especially if you change your mind about the adoption. In addition, it may not be legal in some States for the same lawyer to represent both you and the adoptive parents.
